The Trump administration has hired two lawyers from outside government for its legal team in the Russia investigation.

Trump administration lawyers Ted Olson and Patrick Philbin were confirmed Friday in the D.C. Circuit Court of Appeals.

Olson recently argued unsuccessfully that North Carolina’s ban on same-sex marriages was unconstitutional in Hollingsworth v. Perry, a case in which his home state (with the full support of Republican Governor Pat McCrory) and the Obama administration are the plaintiff. Olson argued before that court that restricting marriage to opposite-sex couples violates the rights of gay Americans to live and marry as they choose.

As solicitor general, Olson led the U.S. Department of Justice in successfully arguing before the Supreme Court that the 2010 Affordable Care Act, the « individual mandate » that requires people to have health insurance, does not violate the Constitution. That case, National Federation of Independent Business v. Sebelius, is the basis for the government’s defense to a lawsuit brought by 26 states and the health insurance industry against the Affordable Care Act.
